Multi-level marketing (MLM) companies have proliferated across the country for quite some time. The temptation to earn easy money is irresistible, given the fact that you can make money by introducing more members. With increasing internet penetration, a lot of MLM companies have gone online. Speak Asia (speakasiaonline.com) is one such firm which is in the news lately for all the wrong reasons.

What is Speak Asia?

It is an online survey company based in Singapore and operating out of Mumbai. It came to India in 2010 and since then its membership has leaped dramatically in such a short span.

How does it work?

You can become a Speak Asia panelist by paying a fee. Once you become a panelist, Speak Asia will e-mail online surveys to you. The first eight weeks are considered to be the training period and the company provides feedback on incorrectly filled forms. After the eight week, Speak Asia starts paying its panelists for completed surveys. Each survey takes around 40 minutes to complete.

Speak Asia has two subscription plans.

1) Standard: You can register as a “Standard” panelist by paying a one-time fee of approximately Rs 5,500 ($120), which provides you subscription to 26 weekly issues of its Online Surveys Today E-bulletin. Here, you respond to two surveys every week and get paid about $10 (Rs 450) a week for six months. Sounds like a good way to double your money in six months.

2) Premium: You can join this plan by paying a one-time annual fee of about Rs 10,000 ($220) and you are eligible to respond to two surveys a week for a year. Again, each completed survey pays you $20 (Rs 900). Since this plan is valid for a year, in three months, the initial capital can be recovered and after that every survey you answer is profit.

This is called “active” income. Refer up to nine friends (the MLM part) and you can get paid for every survey they fill. This is called “passive” income. Plus, there is a concept of team bonus that can make you richer. For every standard panelist you have introduced can earn you $1 every week, while each premium panelist can earn you $3 every week.

What is the mode of payment?

You can become a Speak Asia panelist using your credit card or debit card or a cheque to any of its franchisees.

Speak Asia Online makes the payment in local currency through direct bank transfers. One needs to pay bank transfer charges of 3%. The money is transferred one month after the panelist fills the survey.

What is the eligibility criteria required to be a Speak Asia panelist?

For doing this job, one requires a minimum knowledge of English and internet.

What are the allegations against the company?

• Speak Asia sounds too good to be true and investor associations have alerted investors and the government has announced a probe.
• Investors Grievances Forum has said Speak Asia’s intention is to loot and defraud small, unsuspecting investors. It also asked how a company can pay four times the amount to anyone in one year.
•  Critics are calling it a Ponzi scheme, a racket in which the company pays money to older panelists through payments received from newer panelists, and not from any profit earned by the company
• No legal documents have been provided by the company as a proof for their authenticity.
• Speak Asia is not registered in India and according to a report, this company has changed its name three times in the last five years and is blacklisted for non-compliance in Singapore.
• The names of the clients are not disclosed. It also doesn’t provide names of its top management nor address or any contact details of its offices across the region.

What was the outcome of the press conference which took place in Mumbai?

Speak Asia officials held a press conference on May 16 in Mumbai where the company tried to come out clear of the allegations charged against them. Many questions were avoided or answered in “Yes” or “No”. The officials refused to reveal any details of its clients unless the journalists signed a non-disclosure agreement with them. Meanwhile, Speak Asia officials apologised for mentioning the names of ICICI Bank, Bata, Nestle and Bharti Airtel as their clients.

Speak Asia is also setting up a permanent establishment in India from August and five offices across the country by the end of 2011.

How did Speak Asia become popular?

Speak Asia became popular through media advertising as well as word-of-mouth campaign by its existing panelists trying to enroll more members. It had also published advertisements in leading dailies and also run ad films on TV channels during the IPL matches. According to reports, the company has spent $9 million on advertising, training, PR activities and brand building. Speak Asia has 1.9 million panelists across India, which is a large number.

According to Alexa.com, which ranks websites, speakasiaonline.com was the 49th most popular Indian website and it was ranked 1,192 globally. Speak Asia also has an active group on the social networking site Facebook.com, where the members have jointly voiced their opinion in favour of Speak Asia and have hammered the media for spreading rumours and for the negative publicity.

How much money has it made and how much has it paid panelists?

Speak Asia has clocked a revenue of $80.5 million in the last three quarters, and has paid back $52 million to its panelists. But it has earned $60 million from subscription sales suggesting that there is a direct link between the two. It made $18 million from marketing services through its database. The company also claims to have paid Rs 68 crore as service tax.

Last words

The Ministry of Corporate Affairs, Sebi and RBI will look into the various aspects of the operations of Speak Asia. There are no legal provisions in India to curb MLM schemes so companies in this business can flourish.

In any MLM organisation, the risk a participant faces is when he joined the chain. If the company folds up, people who have joined most recently get affected the most, and can lose a part of their investment. Also, the number of impacted people at the last level in a MLM outfit is the largest. 

As it is said there are no free lunches in this world, so one needs to be cautious about any company making unrealistic claims. After all what we will lose in the end is our hard earned money.

Speak Asia talks of exit option to subscribers

Speak Asia, the survey-driven website, in the news for taking a hefty entry fee from people with the promise of it being a very good investment, appears to be retreating under the scrutiny.

It charges Rs 11,000 as an enrollment fee, with a promise that this money can be more than recouped by responding to their surveys, each response getting you money.

People who have put in money under the impression that they are paying to participate in lucrative surveys may be allowed an exit option to redeem their investment, their legal adviser said here on Friday.

“The main product of the company is the internet magazine. People paying money are buying the subscription of the magazine. I agree some people have been misguided. I will recommend the company to give these people an exit option,” Ashok M Saraogi, the adviser, said at a press conference.

“Even I don’t want people to lose money. If they are a genuine company, they will go by my advice. I am sure they will agree to my recommendations.”

He expected the company to come up with these announcements within a week. According to him, the fee-based surveys, which the company has been marketing as a lucrative work-from-home opportunity, are only additional benefits offered to the subscribers of the magazine. “There is nothing illegal. There is no restriction on an internet business from operating out of a foreign country,” he said.

Speak Asia is not registered with any regulatory authority of India. Critics say the company has been smartly structured to exploit the gaps in various financial sector regulations in the country. There are at least seven financial sector regulators in the country at the last count, but none of these appears to have any jurisdiction over subscriptions received by an online media company, which offers survey as an additional benefit, say legal experts.

What could put Speak Asia in trouble is the apparent intention. Said Saurabh Agarwal, director, Kennis Group, a financial consultancy. “If you are running an online survey business, there is no problem with that. But when you link it with payment of a fee, which is not small, the intention does not seem good”.

“Typically, in these schemes, they will stop paying on one pretext or the other. Having paid the money upfront, the subscriber is left with little choice,” he added.

Neither the company website nor its advertisement campaigns projects Speak Asia’s interests in online publishing. All along, it has marketed itself as an “earn from home” online survey company.

The company’s financial transactions involve a series of transfers through a complex web of holding companies and subsidiaries, according to experts. While money has been collected in the name of Speak Asia Singapore Pte Ltd, payments received by the company’s customers are from other group companies like Haren Ventures, etc.

The company’s website does not give any detail about its associate companies or subsidiaries. Saraogi said disclosures to this effect will be made on the website soon. “We would have made fund transfers to some associate companies. These cannot be termed as siphoning. These are transactions which every company does for accounting reasons,” he said.

Saraogi said the company operated through accounts with ICICI Bank and ING Vysya Bank in India.

Investor forums have asked agencies like Reserve Bank of India, Securities and Exchange Board of India and other regulatory agencies to inquire into the remittances made by the company, including the role of banks.

Speak Asia can withdraw surveys anytime, says its legal advisor

Senior lawyer Ashok Saraogi has said that since Speak Asia is offering reward points for filling up surveys as an additional benefit, it can withdraw these if its contracts with its clients ends. Notably, not a single official from Speak Asia was present during the press conference called by its legal advisor in Mumbai
Speak Asia (SpeakAsiaonline.com) may stop sending surveys and thus paying money through reward points to its panellists anytime and whenever it feels so.

Mumbai-based senior advocate and Speak Asia's legal advisor Ashok Saraogi, said, "The company is not selling any surveys to panellists but e-zines to its subscribers. Surveys are offered as additional benefit and can be withdrawn anytime if the company's contract with clients comes to an end."

Speaking at a press conference today in Mumbai, Adv Saraogi claimed that Speak Asia is selling its magazine over the Internet, which is allowed under the existing law in India and the company is in the publicationbusiness. For the survey business, the company caters to around 50-60 clients, he claimed, without giving out any names. Although Adv Saraogi said that he is a legal advisor for Speak Asia, not a single official from the company was present at the press conference.

There are some news reports about the ownership of Speak Asia which claim that the company is owned by Podium Ring International, a Virgin Islands registered entity and not by Harinder Kaur aka Haren as she is known to all the panellists. Denying the media report, Adv Saraogi said, "Mr Haren and his wife own majority stake in Speak Asia. Its chief executive for India, Manoj Kumar, also holds some stake in the company."

When asked about the bankers of Speak Asia or the lenders used by the company for banking, Adv Saraogi said the company has accounts with ICICI Bank and ING Vysya Bank. However, he could not tell under which names the accounts are opened. Since Speak Asia is not registered nor has any know your customer (KYC) compliance; no bank would open an account using the company's name.

According to Moneylife's investigations, Speak India Network Marketing P Ltd, a registered entity in Mumbai, with Indian directors and Speak India Online, are collecting money from survey panellists and have accounts in ICICI Bank, ING Vysya Bank, State Bank of India and a dozen others. All the people who have enrolled with Speak Asia believe and have been claiming that they are getting money for filing out surveys. Some even said that they have not even heard about the e-zine, for which the company collects Rs11,000. Even the website of the company, the only place where it exists besides Singapore, says it is Asia's largest online surveycompany.

Adv Saraogi, however, says that the company's main product is the e-zine and survey and other activities are "side-products." Asked why then the company's site shows only the survey as the product, Adv Saraogi said, "Jismein jyaada paisa milta hai wohi dikhate hain (We display the products which gives us more money). Any company would like to show its best selling product and hence Speak Asia site shows surveys."

At present, Speak Asia does not offer any refund in case of cancellation of subscription, but Adv Saraogi said he would tell Speak Asia within a week, to allow discontinuation of subscription.

We learn from our investigations and this has been confirmed by Speak Asia officials, that the company is not registered in India and does not have any establishment or office in the country.

This makes it difficult to start proceedings against it, in case somebody wants to file a case. It becomes difficult to file a case in any police station as the company does not have any address in India and hence the police might refuse to lodge a complaint. According to Adv Saraogi, in such cases, one can file a case from whatever location he or she is present and has accessed the website. Police can register a complaint based on the IP address location, he said.

Adv Saraogi added that he would suggest to Mr Haren and his wife, the majority owners of Speak Asia Online Pte Ltd, to set up a permanentestablishment in India.

Speak Asia, which claims to sell subscriptions for an e-zine called 'Surveys Today', issues electronic payment receipts. Adv Saraogi said that the receipts should be issued in the parent company's name. However, when pointed out that Speak Asia has been issuing payment receipts under different names, like Online Surveys Today, Haren Ventures Pte Ltd (HVP), the legal advisor said, people use names of subordinates or subsidiaries to lower tax burdens.

He even cited an example saying that he may ask his client to issue payment in his
subordinate's name, in case he owes some dues to his junior to lessen his own tax burden. 

According to media reports, the Ministry of Corporate Affairs (MCA) has started an investigation into Speak Asia and is working together with the RBI and the Securities and Exchange Board of India (SEBI). Similarly, Bharatiya Janata Party's national secretary, Kirit Somaiyaa, has filed a case against Speak Asia with the Economics Offences Wing (EoW), in Mumbai.

However, Adv Saraogi claimed that as per his knowledge, there is no case registered against Speak Asia anywhere in the country and they have not received any intimation either from EoW or any other authorities.

Mumbai-based Adv Saraogi is a senior lawyer famous for handling mostly criminal cases. He had defended extradited gangster Abu Salem in the 1993 serial blasts trial a few years ago. After the 26/11 attacks in Mumbai, he had even shown his willingness to defend one of the terrorists, Amir Ajmal Qasab, but later dropped the plan after agitations by the Shiv Sena. Last year, he had won a case against Sanjay Dutt over a financial row with producer Shakeel Noorani, which resulted in the attachment of the film star's house and office in Bandra.

In other case, Adv Saraogi also helped yesteryear's film star Manoj Kumar to remove a scene from 'Om Shanti Om' which the thespian had objected to. Shah Rukh Khan, producer of the film, complied.

4. Company is in tie-ups with big brands of India and is going to start advertising their products on it’s website from Feb end/March,2011 and also conduct surveys based on these advertisements.

5. Company is also going to start e-commerce from it’s website from March end/April 2011, where products of various brands will be available at a discounted price from it’s website to the panelists as well as other consumers. Panelists will also benefit from the sale of products as this will add in their business volumes and they will get commissions on it.

6. Company is going to set up it’s Kiosks from September, 2011 (ATM size on-line booking office) all over India in every major area in every city to attract common people get benefit of low price by booking their shopping orders online from Speak Asia. These Kiosks will be owned and managed by selected and qualified panelists and they will earn a huge revenue from sale of products from these Kiosks.

7. By next year in Jan, 2012, Speak Asia will begin a new era in I.T. Industry by intoducing M-Commerce i.e. on-line shopping through your Mobile, thus making dependence on computer ZERO.

8. Company, for technology upgradation, has tied up with one of the biggest Company in IT Sector in the world – IBM to develop the softwares and systems, upgrade its servers and bandwidth to fulfill the demands of carrying out transactions worth thousands of crores through e-commerce and handle the pressure of millions of panelists logging in same day.

9. Company is going to launch it’s own TV Channel in August, 2011 to spread awareness about Speak Asia to common people as well as advertisers and research clients.
